Be mindful of local, state burning laws
Considering recent fire conditions and events within the state and local area, the Holyoke Police Department would like to remind residents of local and state ordinances and laws regarding open burning.

In accordance with Holyoke Municipal Code, Ordinance 2-2014, Section 8.24.010, β€œIt is unlawful for any person to burn any sweeping, trash, lumber, leaves, straw, papers, grass or other combustible material in any street, alley, yard or upon any lot within the city limits.” Fines can be up to $300.

When conditions are manageable, burning permits may be issued by the city superintendent or the chief of police on weekdays between the hours of 9 a.m.-5 p.m. at a cost of $10 at the city administration building.

No permits will be issued or burning permitted on a Red Flag Day or when conditions are deemed too dangerous to proceed. Even if a permit is issued, citizens are reminded that they are responsible for the fire they start.

Colorado Revised Statute 18-4-105 states, β€œA person who knowingly or recklessly starts or maintains a fire or causes an explosion, on his own property or that of another, and by doing so places another in danger of death or serious bodily injury or places any building or occupied structure of another in danger of damage, commits fourth-degree arson.” The statute ranges from a misdemeanor 3 to a felony 4.
